Decree implementing the Patent Box and Tax Credit on expenses for R&D signed
30 July 2015The Minister for Economic Development Federica Guidi and the Minister for the Economy and Finance Pier Carlo Padoan have signed the Decree implementing the so-called Patent Box, which authorizes concessional taxation rates on income deriving from works of the intellect (trademarks and patents). The measure is part of the strategy perfected by the Round Table “Finance for Growth” in which the two Ministries participate. It includes a deduction from income of 30% in 2015, 40% in 2016 and 50% in 2017.
Meanwhile, the decree that implements the tax credit on R&D expenses is about to be published in the Official Gazette. The tax concession is available to all Companies, irrespective of their turnover, their juridical nature, the economic sector where they operate and the accounting system used. The tax concession, which can be used for offsetting, is equal to 25% of the incremental expenses incurred annually in the period 2015-2019 compared with the average of the three previous years. The rate is increased to 50% for expenses relating to the employment of qualified staff and those relating to research contracts with universities or other equivalent bodies and with innovative start-ups. The minimum investment to access the tax allowance is 30 thousand euros, and the maximum annual benefit allowed is up to 5 million euros for each entity.
